BioAlberta, supported by Alberta Research Council - Alberta Innovates Technology Futures, is proud to host a lunch session in both Calgary (June 15) and Edmonton (June 16) presented by the law firm of McCarthy Tétrault.  This informative session is entitled "Going Global: Key Considerations in Cross Border Licenses and Collaborations."
 
This seminar will be presented by: Paul Armitage, Robert Nearing, John Pearson & Catherine Samuel, and will address three key areas of concern when licensing abroad:
  • Payment from foreign jurisdictions
  • Intellectual property protection
  • Risk mitigation

Topics will include:

  • The legal framework to international licenses: contractual choices of law and foreign laws that cannot be contracted out of;
  • Earning money on international licenses: royalty structures, factors affecting royalty rates and tax issues;
  • Risk mitigation strategies: contractual terms, reducing risk and international arbitration;
  • US-specific differences affecting licenses, such as jointly held intellectual property, patent misuse and intellectual property grant backs.
